Terms of Service

These terms govern use of the Solavellum application and this website. By accessing the service you agree to them. If you are accepting on behalf of a brokerage, you confirm you have authority to bind that brokerage.

The service

Solavellum provides software that helps real estate brokerages collect, review, record, and deliver transaction documentation. We grant the brokerage a non-exclusive, non-transferable right to use the service during its subscription term, for its own business.

Accounts and access

Accounts are provisioned by the brokerage. The brokerage is responsible for who it grants access to, for keeping credentials confidential, and for activity under its accounts. Notify us promptly at support@solavellum.com if you believe an account has been compromised.

Your content

Documents, form responses, and other material submitted to the service remain the property of the brokerage. You grant us only the rights needed to host, process, transmit, and display that content in order to operate the service. You are responsible for having the right to submit it and for its accuracy.

Acceptable use

Connected storage accounts

You may connect a third-party storage account so that completed documents are delivered to it. You are responsible for choosing the destination and for the permissions you grant. Your use of that provider remains governed by your agreement with them. We are not responsible for a provider's availability, or for a delivery that fails because access was revoked, quota was exceeded, or a destination folder was moved or deleted.

Not legal or compliance advice

Solavellum is a tool for managing documentation. It does not provide legal advice and does not guarantee that a transaction file satisfies any statutory, regulatory, or brokerage requirement. Responsibility for compliance rests with the brokerage and its licensed personnel.

Fees

Subscription fees, billing period, and payment terms are set out in the brokerage's order or subscription plan. Fees are non-refundable except where stated in that order or required by law.

Availability

We work to keep the service available, but it is provided without a guarantee of uninterrupted operation. We may perform maintenance, and we may modify features as the product develops.

Suspension and termination

A brokerage may cancel at the end of its subscription term. We may suspend or terminate access for non-payment or for a breach of these terms. On termination, the brokerage may request an export of its data within a reasonable period before it is deleted in line with our privacy policy.

Disclaimers and liability

The service is provided "as is," without warranties of any kind to the fullest extent permitted by law. To the fullest extent permitted by law, our aggregate liability arising from the service is limited to the fees paid by the brokerage in the twelve months preceding the claim, and we are not liable for indirect, incidental, or consequential damages.

Changes to these terms

We may update these terms. Material changes will be posted here with a revised date and notified to account administrators before taking effect. Continued use after that date means you accept the revised terms.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. The courts located in Texas have exclusive jurisdiction over disputes arising from them.
